GRUPO MARKTEST companies are dedicated to market research and software development, each of which is dedicated to carrying out research and/or developing specific computer tools that they carry out on their own initiative or at the request of their clients.

This Privacy Policy explains how the MARKTEST GROUP companies, hereinafter referred to as MARKTEST, treat the Personal Data entrusted to them by their customers or by the data subjects themselves through coupons, telephone, e-mail or forms on platforms and/or websites controlled by MARKTEST (hereinafter collectively referred to as MARKTEST Websites).

MARKTEST's practices and MARKTEST's website's privacy practices are in compliance with MARKTEST's Privacy Policy. Before providing Personal Data to MARKTEST, we recommend reading this Privacy Policy as different forms of processing of your Personal Data may occur. By providing your Personal Data, by accessing and using the MARKTEST Websites, the Data Subject accepts and authorizes the collection, use and disclosure of your Personal Data (information that may identify you), as provided in this Privacy Policy.

Processing of personal data

Legitimacy for Processing

In the exercise of its activity MARKTEST needs to collect and process a set of personal data, which, being essential to its activity, are collected only with the consent of the Data Subjects.

With the authorization of Data Subjects, their data are: (i) used for marketing research or opinion polls in progress and, if consented, (ii) inserted in a computerized database owned by MARKTEST for participation in further studies. In such cases, it is up to the Data Subjects to decide whether to consent to the use of their data by MARKTEST.

MARKTEST offers to registered users of the Website a set of services described therein, requiring the collection and processing of some Personal Data. In this case the provision of Personal Data is optional but necessary if the Users of the Website wish to benefit from the services available there.

Processed data

As Personal Data controller, MARKTEST collects the following Personal Data: NAME, GENDER, EMAIL ADDRESS, PHONE (optional), without prejudice to other data that may be requested later for the purposes described in this Privacy Policy.

In order to carry out certain research or surveys, MARKTEST may only need information regarding the opinion or preference of the Data Subjects, without any need to collect and process Personal Data.

MARKTEST may also contact Data Subjects by telephone for surveys or certain research using a program that randomly generates telephone numbers, so that at the time of the contact it does not know the identity of the Data Subjects. In this contact, in addition to requesting consent to proceed with the interview, the following Personal Data may be requested NAME, GENDER, DATE OF BIRTH, SCHOOL EDUCATION, PROFESSION, HOME PHONE NUMBER, MOBILE PHONE NUMBER, E-MAIL, HOUSEHOLD COMPOSITION.

For certain research, MARKTEST may collect Personal Data of underage persons. When it does so, it requests that the consent be provided by the holder of parental responsibilities and requires confirmation of that circumstance.

The services provided on the MARKTEST websites are intended for persons over 18 years of age, therefore, in this context, MARKTEST does not voluntarily collect or treat on its websites any data of underage persons that are not duly authorized and/or supervised by their parents and/or representatives. By accessing the MARKTEST websites and providing your data, the User declares that he or she is over 18 years of age or authorized by his parents and/or representatives for this purpose.

Processing Purposes

The aforementioned Personal Data provided by its subjects to MARKTEST are processed by MARKTEST for the following purposes:

  2. Allow to register on MARKTEST websites and proceed to the subsequent access management;
  3. Delivery of the several services available on MARKTEST websites;
  4. Satisfy and respond to all requests from MARKTEST Data Subjects and thus manage their relationship with MARKTEST;

  12. Sending the Marktest Newsletter;
  13. Sending information and commercial communications, if the Data Subjects so request or give their express consent for this purpose.

With the explicit consent of the Data Subjects, MARKTEST may use Personal Data for the purpose of sending advertising, promotional and newsletters. The Data Subject may at any time withdraw his consent to receive these advertising communications, using the link to "Unsubscribe" available in all the communications sent to him, by sending an e-mail to the Data Protection Officer to the address epd@marktest.pt or by postal mail to Data Protection Officer, Marktest, Rua Padre Luís Aparício n.º 10, 1º 1150-248 Lisboa. If the User refuses to give his consent or withdraw his consent, MARKTEST will not be able to inform him of initiatives, offers, news or advantages that may have interest in and/or send other commercial information about MARKTEST services.

In no case will the Personal Data of Users be used by MARKTEST for the purpose of sending advertising communications without his/hers express consent.

Processors and communication of data to third entities

Personal Data entrusted to MARKTEST will be object of pseudonymisation in the research conducted, reason why will not, normally, be communicated to any third party. MARKTEST only discloses the results of the research itself.

Personal Data provided to MARKTEST will be handled by MARKTEST employees and collaborators duly authorized to carry out the respective processing in the performance of their duties and functional and contractually obliged to treat Personal Data in accordance with the law and this Privacy Policy.

Without prejudice, Personal Data may also be processed by processors, which will handle the data according to instructions and on behalf of MARKTEST, for example, for the maintenance and technical management of the IT system and the management of information systems or other.

Data Processing conditions

MARKTEST, as Personal Data controller, observes all applicable legal provisions regarding the processing of the data collected. MARKTEST guarantees the quality, accuracy, integrity and confidentiality of the data entrusted to it, as well as the legitimacy for its processing under the legal terms, namely the lawfulness, security and confidentiality of the processing, the non use of personal data for purposes other than those stated at the time of collection, except with the express prior consent of the data subject, and the retention of the data only for the period necessary for the purposes of the processing

MARKTEST has appropriate technical and organizational measures to protect the personal data of Data Subjects against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure and / or access. MARKTEST uses appropriate systems and procedures to protect and safeguard the integrity of the Personal Data provided to it, namely, organizational, technical and physical security restrictions to access servers, prohibition of unauthorized access, clean desk policies, functional separation of the data, policies of login and password access to networks, conditioned access to the facilities where only authorized employees can access personal data during the performance of their work and for the purposes indicated here. Without prejudice, and to the maximum extent permitted by law, MARKTEST shall not be liable for attacks or any unlawful acts of third parties.

Period of data storage

In accordance with the law, MARKTEST will only treat Personal Data for the period necessary for its processing. After that period the data will be deleted or anonymized so as not to allow the identification of Data Subjects.

For the purpose of market research and interview databases, user data will be kept for a period of 5 years.

For the purpose of online panels and measurement of Internet traffic, user data will be kept for a period of 5 years.

For the purposes of the website, user data will be kept for a period of 3 years.

For statistical purposes, the data of the Users will be anonymized in a way that will not allow the identification of their subjects and will be kept indefinitely.

Data Subjects rights

MARKTEST assures Data Subjects of all legally established rights, including the right to obtain confirmation that their data is being processed, as well as all information relating to such processing, to know the source of the data, recipients or categories of recipients to whom the Personal Data has been or will be disclosed, as well as know the expected period of storage of their Personal Data. MARKTEST also assures the exercise of the rights of access, opposition and/or limitation to the data processing, revocation of consent, portability, as well as the possibility of updating, rectification or elimination of the personal data by the respective Subject.

MARKTEST will allow the exercise of the rights of the Data Subjects at all times in accordance with applicable law by contacting MARKTEST in writing.

The legitimate requests of the Data Subjects will be met by MARKTEST within thirty days. This period may be extended for a further thirty days, if absolutely necessary and by sending prior justification.

MARKTEST handles the Data Subjects' Personal Data in accordance with the requirements of the applicable legislation. Without prejudice, if any user understands that MARKTEST does not comply with the law or does not respect his or her rights, he or she may submit a complaint to the National Data Protection Commission.

Browsing data

MARKTEST uses in its Websites software and computer systems that collect, during its normal operation, some personal data (called registration files), the transmission of which is implicit in the use of Internet communication protocols.
